Terms of Service

Understand eluai's service, eligibility, billing and refunds, AI output rights and responsibilities. Read the AIGC Acceptable Use Policy and Privacy Policy before creating or purchasing.

Version 2026-10-14.1Updated and effective:October 14, 2026

1. Service description and scope

eluai is operated by Xiao Shuhao and provides internet-based AI creation software, including text-to-image generation, reference-image editing, video generation, conversational creation, infinite canvas workflows, inspiration templates and work management. These terms apply to accounts, creation, credit purchases and support on the website and iOS app.

Read these terms, the Privacy Policy and the AIGC Acceptable Use Policy (AUP) before registering, buying credits or submitting tasks. If you disagree, do not register, purchase or use the relevant services. Availability, specifications and generation time depend on third-party AI models and interfaces. Crediting an account does not mean a generated work has been delivered; delivery depends on the actual task result.

2. Account eligibility and security

You must have the legal capacity required by applicable law, provide an accurate email address you can continue to access, and protect your verification codes and login credentials. Minors must use the service with a guardian's consent and guidance and must not independently purchase paid services without that consent. Information processing requiring guardian consent must separately meet relevant requirements. You must be authorized to act for an organization you represent.

Do not misuse another person's account, transfer or share login credentials, or obtain benefits using false identities. You are responsible for your actions and authorized use. Report account misuse, unexpected charges or compromised credentials to support WeChat luyuhao0422 promptly. Responsibility is determined by actual fault and applicable law.

3. Billing, payments and credits

Usage is billed in credits, with 1 credit corresponding to CNY 0.01. Model, operation, resolution, output count and video duration affect usage. Review the selected model and estimated credits before submission. Estimated credits are held on submission, then successful nodes are settled by actual usage and the unused hold is released. If every node fails with zero usage, the entire hold is released; partial success is charged for the successful portion.

Each recharge is a one-time purchase. Payment authorization covers only the amount displayed for that checkout and does not authorize a subscription, automatic renewal or automatic recharge. Available payment methods, currencies, packages, taxes where applicable and bonuses are shown on the recharge page and checkout confirmation. Credits are granted according to order status after payment confirmation; contact support about missing credits.

Credits are for platform services and are not deposits or a cash-withdrawal wallet. Purchased credits have no standard automatic expiry date. Promotional or bonus credit uses and validity follow the terms shown when claimed, such as daily check-in credits being limited to image generation. Package, model or price changes apply to later purchases or tasks and do not retroactively increase charges for settled tasks.

4. Refund rules and eligibility

Cash refunds are reviewed manually by support. Consumed services that have been properly delivered are generally non-refundable, except for incorrect charges, platform failure to perform as agreed, and refunds required by law. A successful output that does not meet personal expectations differs from task failure; provide the task ID and specific issue for review. Regenerating creates a new task and may incur new usage.

  • Duplicate payment: after verifying duplicate payments for the same purchase, refund the duplicate portion.
  • Incorrect charge: verified discrepancies against the order or actual settlement are corrected; cash payment errors are refunded according to verified findings.
  • Platform-related issues: where paid services were not provided as agreed, refunds are handled for the unfulfilled portion under applicable requirements.
  • Mistaken purchases or unused balances: handled through manual discussion based on the order, usage and applicable requirements. Statutory cancellation, refund and consumer rights remain protected.

5. Credit release and cash refund calculation

Credit release after task failure restores account capacity and does not automatically return cash. Cash refunds are calculated from the order's actual payment, delivered services, prior refunds and credit records, rather than multiplying the total credit balance by its conversion rate. Bonus, referral and promotional credits cannot be separately redeemed for cash; they do not remove statutory refund rights.

After a refund is confirmed, related unused credits or benefits are adjusted to prevent duplicate refunds or retention of refunded benefits. Contact support about unreleased holds, missing credits or settlement disputes with relevant order, task and transaction records.

6. Refund and billing dispute process

Add support WeChat luyuhao0422 and state 'Refund request' or 'Billing dispute'. Provide your account email or user ID, order ID, payment amount and time, and necessary payment evidence. For usage disputes, include the task ID and time. Redact irrelevant information and never provide passwords, verification codes or full bank card details.

Support reviews payment, credited amounts and usage and explains the result and calculation. For eligible refunds, support confirms the amount, benefit adjustments, method and expected processing time. Refunds go to the original payment method where possible; otherwise, arrangements are discussed with the verified payer. Receipt time depends on the payment channel. Submitting a request does not mean a refund has occurred. Retain the records and avoid duplicate requests.

7. AI output and intellectual property

You retain existing rights in inputs and must have a lawful basis to use prompts, images, videos and other materials, including necessary copyright, trademark, likeness and privacy permissions. You grant the platform a limited, non-exclusive license necessary to execute tasks, store and display work, protect safety and resolve disputes. This does not transfer ownership of inputs.

Within the limits of applicable law, third-party rights and the selected model's license, you may use, modify and lawfully commercially use your outputs. The platform does not claim output rights that legally belong to you, but does not guarantee copyright protection, exclusivity or non-infringement for every output. Different users may receive similar outputs. Verify accuracy, permissions and applicable restrictions before publishing or commercial use.

Rights in names, marks, interfaces, software and templates remain with their respective holders. Third-party models process inputs as needed; upstream retention and training rules may differ. See the Privacy Policy. Label or disclose outputs as AI-generated and do not misrepresent them as real events or professional work.

8. Acceptable use

Use the service only for lawful creation. The AIGC Acceptable Use Policy (AUP) forms part of these terms and covers prompts, uploads, outputs and sharing. It explicitly prohibits pornography/NSFW, violence/gore, hate speech, child-unsafe content (CSAM), deepfakes/impersonation, and copyright/trademark infringement.

Do not commit fraud, harass others, distribute unlawful information, create malware or conduct cyberattacks. Do not bypass moderation, abuse rewards, disrupt systems, misuse accounts or resell access without authorization. Do not use outputs to impersonate real individuals, organizations or professionals. See the AUP for standards, reports, moderation and enforcement.

9. Disclaimers and liability limits

To the extent permitted by law, the service is provided as is and as available, without guarantees of uninterrupted operation, elimination of all errors or fitness for a particular purpose. AI outputs may be inaccurate, incomplete, outdated or inappropriate and require human review. They are not substitutes for medical, legal or financial advice. Upstream interruptions do not remove the platform's legally required performance, refund or other responsibilities.

To the extent lawful and without reducing statutory consumer rights, aggregate compensation for ordinary contractual breach is limited to the service fees actually paid to the platform during the 12 months preceding the event giving rise to the claim. Liability for indirect loss or lost expected profits follows law. This limit excludes personal injury, property loss caused by intentional misconduct or gross negligence, and liability that cannot legally be limited. It does not limit legally required refunds.

10. Breach, suspension and termination

Violations may result in rejected generation, required corrections, removal of violating shared content, feature restrictions, suspension or termination based on severity. CSAM, terrorism, serious infringement, fraud or other urgent risks may trigger immediate action and lawful cooperation with authorities. Reasons and appeal instructions will normally be provided except where prohibited or where disclosure would obstruct an investigation.

You may ask support to stop using the service or close your account; data is handled under the Privacy Policy. If the platform terminates paid services for its own reasons unrelated to your breach, the prepaid unfulfilled portion is refunded after verification. Violating account balances are reconciled against orders, actual delivery and law, not automatically forfeited in full. Existing tasks, refunds, disputes and legally retained records continue to be handled after termination.

Appeal restrictions or termination through support WeChat luyuhao0422 with your account or task ID, notice and reasons. The operator reviews facts, communicates the result and corrects restrictions or billing where warranted.

11. Updates and dispute resolution

Material changes are reflected in the page date and version, with major changes communicated through site notices or appropriate contact channels. Fresh consent is obtained where legally required. Existing orders follow the terms at purchase, actual delivery and applicable law; updates do not unilaterally reduce existing rights. Invalid provisions do not affect other valid provisions.

These terms are governed by the laws of the People's Republic of China without excluding mandatory consumer protections in your location. Contact the operator to review service, billing, refund or content disputes. If discussion does not resolve the dispute, you may contact competent authorities or seek relief in a court with jurisdiction.
